1. Privacy Policy (GDPR)

In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation), WebFrameNetworks collects and processes personal data submitted through our contact forms and project intake consoles exclusively for the purposes of client communication, project delivery, and statutory tax reporting obligations.

Categories of Personal Data: We collect the following categories of personal data: full name, email address, phone number, company name, project specifications, and communication preferences. This data is collected directly from you via our contact forms.

Legal Basis for Processing: We process your personal data based on your explicit consent (Article 6(1)(a) GDPR) when you submit a contact form, and based on our legitimate interest in responding to your inquiry (Article 6(1)(f) GDPR).

Data Retention: Personal data submitted through our contact forms is retained for a maximum period of 24 months from the date of last communication, unless a commercial engagement is established in which case data is retained for the duration of the engagement plus 6 years for statutory record-keeping.

Third-Party Processors: We do not sell, rent, or distribute personal information to unauthorized third parties. Data is stored within encrypted EU-hosted cloud infrastructure. Our hosting providers are bound by Data Processing Agreements (DPAs) in compliance with Article 28 GDPR.

Your Rights: Under the GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, and port your personal data. You also have the right to lodge a complaint with your local supervisory authority.

2. Terms of Service

These Terms of Service ("Terms") govern the provision of web design, UI architecture, and spatial interface development services by WebFrameNetworks ("we," "us," "our") to the client ("you," "your"). By engaging our services, you agree to be bound by these Terms.

Scope of Work: All services are delivered according to a mutually agreed Statement of Work (SOW) or project proposal. Any modifications to the agreed scope must be documented in a written change order signed by both parties.

Payment Terms: Invoices are due within 14 days of issuance unless otherwise specified in the SOW. Late payments may incur a fee of 1.5% per month on the outstanding balance. We reserve the right to suspend work on any project where payment is overdue by more than 30 days.

Intellectual Property: Upon receipt of full payment for all agreed deliverables, WebFrameNetworks assigns all worldwide intellectual property rights in the client-specific deliverables, including source code, design tokens, and digital assets, directly to the client. WebFrameNetworks retains the right to display work in its portfolio unless otherwise agreed in writing.

Warranty: WebFrameNetworks warrants that all deliverables will conform to the specifications outlined in the SOW for a period of 30 days following delivery. This warranty does not cover issues arising from unauthorized modifications, third-party integrations, or hosting environment changes.

Limitation of Liability: In no event shall WebFrameNetworks be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the total fees paid by you for the specific service giving rise to the claim.

Termination: Either party may terminate this agreement with 14 days written notice. Upon termination, the client shall pay for all work completed up to the date of termination. All completed deliverables and associated IP shall be transferred to the client upon receipt of payment for completed work.

4. Refund & Reimbursement Policy

WebFrameNetworks is committed to delivering exceptional web design and UI architecture services. We understand that circumstances may change, and we offer the following refund and reimbursement terms.

Pre-Project Cancellation: If you cancel a project before work has commenced, you are entitled to a full refund of any advance payment within 14 business days. Cancellation must be communicated in writing to [email protected].

In-Progress Cancellation: If a project is cancelled after work has commenced, you will be invoiced for all work completed up to the date of cancellation. Any advance payment exceeding the amount invoiced for completed work will be refunded within 14 business days.

Deliverable Disputes: If you believe a delivered milestone does not meet the specifications outlined in the SOW, you must notify us in writing within 7 days of delivery. We will review the discrepancy and, if warranted, rectify the deliverable at no additional cost within 10 business days.

Non-Refundable Items: Third-party costs incurred on your behalf (such as domain registrations, hosting fees, software licenses, or stock asset purchases) are non-refundable once procurement has been confirmed. These costs will be itemized separately on your invoice.

Refund Processing: All approved refunds will be processed within 14 business days using the original payment method. If the original payment method is unavailable, we will coordinate an alternative refund method with you.

Dispute Resolution: Any disputes arising from these Terms or the provision of services shall first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may escalate the matter to mediation or binding arbitration under the laws of Germany.
